Terms & Conditions
These terms and conditions apply to all tours booked with Namaste India Vacations, a travel
company based in Agra, India. These terms and conditions govern the contractual relationship
between Namaste India Vacations and you. Please read these terms and conditions carefully, as by
booking your trip with Namaste India Vacations, you confirm that you have read and understood
these terms and conditions and that you agree to be bound by them and their terms and
conditions. If you have confirmed bookings with more than one named customer and booked a
booking in that booking, you will be deemed to have accepted these terms and conditions on
behalf of all named customers in the booking (including minors and people with disabilities).
and therefore all customers in this group indicate their acceptance and agreement to these terms
and conditions. The customer with a confirmed booking will be considered the selected contact
for all other customers named on that booking.
All correspondence in respect of tours, travel services, and bookings should be addressed to
Namaste India Vacations.
Booking
Once your booking is confirmed, you will enter into a contract with Namaste India Vacations.
There is a contract between us when we confirm your travel or travel service, and these terms
and conditions will apply once Namaste India Vacations has received the appropriate deposit from
the customer and the customer has received written confirmation from Namaste India Vacations of
that booking. Guests confirming a reservation must be 18 years of age or older and agree to
provide full, complete, and accurate information as requested by Namaste India Vacations to
confirm the reservation.
Travel Insurance
Namaste India Vacations does not provide travel insurance; therefore, guests must purchase travel
insurance in their home country with minimum recommended medical, evacuation, and repatriation
coverage, covering all applicable dates of any travel with Namaste India Vacations. This
insurance will cover personal injuries and emergencies, as well as medical fees. We strongly
recommend that customers extend their insurance coverage to include trip cancellations and any
other costs that may arise due to loss, damage, injury, delay, or unexpected occurrence. profit.
Customers have to endure. The cost of the trip does not include any insurance for the customer,
and the customer must purchase separate insurance at an additional cost to the price of the
trip. When purchasing travel insurance, customers must ensure that the insurance company knows
the type of trip that will be taken so that the insurance company can properly cover the travel
during the particular trip.
Payment
For booked services, a minimum deposit of 25% of the total trip cost is required from Namaste
India Vacations. A deposit is required to hold the booking on a confirmed basis.
Please note: In addition to the above, in the case of special train
travel bookings or hotel or resort bookings during peak season (Christmas, New Year,
Pushkar Fair, Diwali, etc.), full payment must be made at the time of booking.
Even after making a 25% advance to confirm your booking, in some cases you may be required
to pay an additional advance before the final balance payment date, depending on the payment
terms of contractors or suppliers, if any.
Balance Payment
The balance payment must be made 15 days prior to the service start date.
Any booking made within 15 working days of the service will be considered a late booking, and
full and final payment must be made at the time of booking.
Medical Conditions
All customers are required to truthfully provide the relevant medical information requested by
Namaste India Vacations when booking their tour. Customers are responsible for evaluating their
own suitability and ability to participate in a tour with us. All customers should consult their
doctor regarding their suitability to attend the pre-booked visit. Namaste India Vacations
recommends that all travelers seek their physician's advice regarding required or recommended
vaccinations, medical precautions, or other medical matters related to their entire trip.

The India tours offered by Namaste India Vacations include visits to remote or underdeveloped
areas of India where medical facilities may not meet the standards of medical facilities for
their original customers. The condition of medical facilities in these areas varies, and Namaste
India Vacations makes no representations or warranties regarding the quality of such facilities
or medical treatment in these areas.
Mode of Payment
International customers can make payments using one of the following methods:
- By Online Credit Card Payment (American Express, Visa, Master Card, Discover, or Diners
Club)
- By online debit card payment (by Master, Visa, or Maestro)
- By Offline Credit Card Payment (American Express, Visa, Master Card, Discover, or Diners
Club)
- By bank or telex transfer to our bank account
Note:
- When paying by credit or debit card, a 3% bank fee would be levied over the total amount.
- All payments should be free and clear of any withholding tax or deduction.
- Bank charges, if any, for remittance (by remitting bank or by intermediary bank) would be
strictly borne by the payer.
Special Request (Be Alert)
Please note that Namaste India Vacations employees
or agents will not ask you for your card number, CVV, Net Banking ID, password, OTP, etc. They
also won't ask you to transfer money to your personal account or install third-party apps like
Any Desk, TeamViewer, etc. Please do not respond to such requests. Report such incidents to
info@namasteindiavacations.com.
Cancellation Policy / Early Departure
Applicable cancellation fees will be determined based on the date Namaste India Vacations
receives the cancellation request and are expressed here as a percentage of the total price
charged for the cancelled trip. Our cancellation policy is given on every page, at the bottom of
every tour page, and on the description page of Namaste India Vacations. The below cancellation
policy will only work for those tours that do not have a cancellation policy on their
description page.
In case of cancellation, all tours have a cancellation policy on their
description page. If any tour does not have a cancellation policy in its details section, then
the below cancellation policy will be levied:
- 60 days prior to arrival: 10% of the tour or service cost.
- 59 days to 30 days prior to arrival: 20% of the tour or service cost
- 29 days to 15 days prior to arrival: 25% of the tour or service cost
- 14 days to 8 days prior to arrival: 50% of the tour or service cost
- 07 days and less prior to arrival or no show—NO REFUND.
Refund
Regarding refunds for unused or cancelled services (paid and cancelled in advance), the
refund amount will be calculated based on the cancellation policy described above, and the
amount will be refunded accordingly to the person making the payment. Please note that
refunds may take 2-4 weeks due to banking procedures. If a refund is made to a credit card
account or to a bank account, bank fees will be debited from the refund amount.
Mandatory Identification Documents
All guests (foreign nationals, NRIs, and Indian citizens) are required to provide their photo
identification at the time of booking confirmation. The documents, as per the details given
below, are applicable to different categories:
- For foreign nationals, a copy of their passport and visa is mandatory.
- For non-resident Indian clients (NRI clients), a copy of their passport
- For overseas Indian clients holding an OCI or PIO card, a copy of their passport and a copy
of their OCI or PIO card are mandatory.
- For domestic clients, a copy of their driving license, voter ID card, or passport is
mandatory.
Arrival and Departure Policy
Check-In Timings: 1200 – 1500 Hours (IST)
Early arrival is subject to availability. To ensure early check-in, guests must make a
reservation the night before.
Check-Out Timings: 1000 – 1200 Hours (IST)
Late check-outs are available on request and subject to availability and payment.
Extra Usage of Vehicle
Please note that the cost of using additional vehicles (cars or buses with drivers) is
not included in the service, and therefore, additional use of vehicles after transfers or after
sightseeing is not included.
Prices, Surcharges and Taxes
Due to the nature of the tourism industry in India and the prices of the resources on which it
depends, the published price of any India tourism product is subject to change at any time,
before or after confirmation. reservations, up to 30 days before departure, for such a journey.
Namaste India Vacations reserves the right to impose surcharges on all travel products, but only
for reasons arising from increased accommodation costs, transportation costs, fuel costs, fees,
taxes, or charges payable for services such as third-party supplier costs, currency fluctuations
and foreign exchange prices, parking fees, tax increases, or government actions affecting the
price of the applicable tours, but only if the increase in question is significant enough to
justify the right to impose such surcharges. Namaste India Vacations will notify affected
customers as soon as possible upon becoming aware of the need to impose a surcharge under this
section. After receiving notice from Namaste India Vacations, the customer(s) concerned can
choose either:
Cancel the relevant tour booking without incurring any penalty, or accept price changes.
The customer must inform Namaste India Vacations about their choice within 14 days of receiving
notice of the price increase; otherwise, they will be deemed to have accepted the price change
and to have accepted responsibility for paying the price increase. From time to time, Namaste
India Vacations may offer discounted rates on certain tours. The promotional price applies to
new bookings only. Confirmed bookings (i.e., bookings for which Namaste India Vacations has paid
at least a deposit) will not be eligible for discounts.
Guaranteed Departures and Cancellation of a Tour by Namaste India Vacations
Namaste India Vacations guarantees that all scheduled group departures booked by the customer
will depart on schedule (subject to reasonable itinerary changes). Brochures and other printed
materials displaying tour information and departure dates are subject to change, and these dates
are not included in this guarantee. Departure will be guaranteed when at least one customer
confirms the booking. This guarantee does not apply in the event of force majeure. If a trip is
cancelled by Namaste India Vacations before the agreed departure date for reasons not arising
from force majeure, fault, or negligence or within the customer's reasonable control, the
customer must choose. Accept from Namaste India Vacations an alternative travel product of equal
or greater value, if such an alternative product is reasonably available; accept from Namaste
India Vacations an alternative tour of lesser value if no tour of equal or greater value is
available; recover from Namaste India Vacations the difference between the price of the tour
given the original purchase and the price of the replacement tour; or accept from Namaste India
Vacations a full refund of the amount paid for the cancelled trip.
Namaste India Vacations is not responsible for any additional costs or consequential losses the
customer may incur as a result of a cancelled booking, such as visas, vaccinations,
non-refundable flights or train returns, non-refundable parking fees or other fees, loss of
ticket revenue or loss of use, etc. Namaste India Vacations reserves the right to provide a full
refund in lieu of the above options, at its sole discretion. If, after departure, a significant
part of the tours described cannot be carried out, Namaste India Vacations will arrange suitable
alternatives for the continuation of the tours. If a suitable alternative cannot be provided or
the customer reasonably rejects any suitable alternative, Namaste India Vacations will refund
the customer unused or partial travel or tourism products.
OUR LIABILITIES AND LIMITATIONS:
Please note that after finalizing the cost of the tour or service, if there is any increase in
monument or museum entrance fees, taxes, fuel fees, or government guide fees from India, the
same will be charged additionally.
Namaste India Holidays prices are based on current rates we have negotiated with hotels,
airlines, etc. Hotels and airlines reserve the right to change prices without prior notice. In
the event of such changes, the prices specified by us before the amendment may be revised by us,
subject to changes made by the hotel or airline.
All exchange orders, receipts, contracts, and tickets issued by Namaste India Vacations and its
affiliates are subject to the terms and conditions under which these services are provided by
the hotels, airlines, transporters, railways, and contractors providing other services. The only
contract between the clients and such contractor shall be the tickets, coupons, or passage
contract in use by the carrier, hotel, or other contractor offering services.
Namaste India Vacations: The itinerary is a sample itinerary intended to give you a general idea
of a likely travel itinerary. Many factors, such as weather, road conditions, participants'
physical abilities, etc., can cause route changes before or during the journey. Namaste India
Vacations reserves the right to change any aspect of the itinerary, including transportation and
accommodation, without notice, in the interest of travel, safety, comfort, and the general
well-being of the participant, without granting any discount, subsidy, refund, or additional
fees, if any, which will be the responsibility of the customer.
Namaste India Vacations is not responsible for any delays, program changes, costs incurred, or
direct or indirect special or consequential losses due to natural disasters, flight
cancellations, accidents, machinery or equipment failures, transportation failures, etc. We are
not responsible for any injuries or damages. weather, disease, landslides, political shutdowns,
natural disasters, maritime crises, floods, fires, acts of government or other authorities, war,
riots, riots, theft, theft, epidemics, quarantine, medical or customary sector regulations,
debts; FAILURE OR OTHER CAUSES BEYOND OUR CONTROL, OR ADVERSE EVENTS OR SIMILAR CAUSES,
INCLUDING ANY LIABILITY OR ADDITIONAL COSTS INCLUDED BY CUSTOMER Additionally, any liability or
additional costs incurred due to the above reasons shall be borne by the customer.
Namaste India Vacations shall not be liable to the customer or his legal representative for any
loss or damage to property resulting from death or personal injury, including loss of services
provided by the customer, due to any act, negligence, or conduct. We also assume no legal
responsibility. Transport companies, hotel agents, other persons of any kind, agents or service
providers offering such services or facilities, or tours, transportation, or other services,
whether or not under ownership; any default arising out of or during participation in;
maintenance, use, operation, or control of public transportation or other motor vehicles,
bicycles, boats, motors, or other vehicles, whether negligent or not, or whether caused by
negligence or otherwise; use of sporting equipment, bicycles, yachts, and diving equipment
rented or provided by hotels or rental companies is at your own risk.
Namaste India Vacations does not have insurance to cover expenses due to accident, illness,
theft, or any other reason. Visitors are advised to purchase such insurance in their home
country. All luggage and personal effects are at your risk at all times.
Namaste India Vacations reserves the right to refund the relevant amount if the tour, excursion,
or traverse is determined to be impracticable for any reason or the circumstances justify such
action. reserves the right to cancel the service without further notice to you. We reserve the
right to make further cancellations. insist on any reason
Namaste India Vacations reserves the right, in its sole discretion, to refuse to perform a
contract with any person it deems to be undesirable and shall not be obligated to provide
reasons therefor.
Force Majure
Namaste India Vacations (Company) and its parent, subsidiaries, affiliates, officers, directors,
employees, agents, or suppliers, and their respective successors and permitted assigns, shall be
liable for any failure or delay. shall not be held liable or deemed to be in default. The
performance of the obligations under this Agreement, in whole or in part, shall not be caused by
any declared or undeclared act of war, sabotage, embargo, act of terrorism, riot or other civil
commotion, or by any occurrence of the transport failure, act of any government, court, or
administrative authority thereof, act of God, fire, explosion, flood, earthquake, strike, act of
government or other disaster, pandemic, epidemic, disease outbreak, quarantine restriction, or
reasonable other causes beyond our control. Namaste India Vacation (“Force Majeure”)
Both Namaste India Vacations (the company) and the customer (you) shall use their best efforts to
avoid, overcome, or offset the effects of any cause or potential cause of a force majeure event.
Once the force majeure event ceases to exist, the general terms and conditions contained herein
will be fully applicable again. However, the occurrence of a force majeure event does not
relieve Namaste India Vacations (us) and the customer (you) from any obligations incurred prior
to the occurrence of the force majeure event.
JURISDICTION CLAUSE:
All the disputes arising out of this agreement or any other subsequent agreement would be subject
to Delhi Courts only.
Complaints
The customer agrees to report any travel-related complaints to Namaste India Vacations as soon as
possible so that Namaste India Vacations has an opportunity to resolve the complaint
appropriately. The client undertakes to notify the principal instructor or any other designated
representative of Namaste India Vacations as soon as possible. Namaste India Vacations is not
responsible for complaints not reasonably brought to Namaste India Vacations' attention and will
give adequate notice to Namaste India Vacations to resolve or attempt to resolve customer
complaints. Any claims made after the end of a trip must be received in writing by Namaste India
Vacations within 30 days of the end of the trip in question.
Amendments
Namaste India Vacations reserves the right to update and/or modify these terms and conditions at
any time and will post the revised terms and conditions on the Namaste India Vacations website.
Such modifications will take effect 10 days after publication on the website. You can view
the latest conditions, as amended, at any time on the Namaste India Vacations website. Namaste
India Vacations recommends that all customers refer to the Terms and Conditions before their
trip to familiarize themselves with the latest version of the Terms and Conditions.
